Terms of Service

1. ACCEPTANCE OF TERMS
foomchat is operated by Scry Labs LLC ("we", "us"). By accessing or using foomchat, you agree to these Terms of Service. If you do not agree, do not use the service.
2. WHAT FOOMCHAT IS
foomchat is an AI chat application that can write user-interface features on request. When you ask for a tool or a change to the app, the AI answers with real code (HTML, CSS, and JavaScript) packaged as an installable feature. Installing a feature runs that code live in your browser and modifies your copy of the interface. You can keep features private, edit them, roll them back to earlier versions, or submit them for review to be published in the public marketplace.
We may modify, suspend, or discontinue any part of the service. We will make reasonable efforts to give notice of significant changes.
3. ACCOUNTS
- Sign-in is handled by Auth0, using Google or an email and password. You are responsible for keeping your login secure.
- You must be at least 13 years old (or the age of digital consent where you live).
- One person may not create multiple accounts, including to collect free starter credits more than once.
- Accounts are non-transferable.
4. CREDITS, SUBSCRIPTIONS, AND PAYMENTS
- Using the AI consumes credits, metered by the amount of text the AI processes and produces. The exact metering may change; current rates are always shown on the Account page.
- New accounts receive free starter credits after verifying their email address — once per person.
- Subscriptions (Basic and Pro) grant a monthly credit allowance that resets at each billing cycle; unused subscription credits do not roll over. Top-up credits do not expire.
- Payments are processed by Stripe. We never see or store your card number.
- You can cancel a subscription at any time from the Account page; cancellation takes effect at the end of the current billing period. Your remaining subscription credits stay usable until then, and top-up credits remain after cancellation.
- Credits have no cash value, are non-transferable, and are non-refundable except where required by law.
- Prices may change; changes will not affect an already-paid billing period.
5. USING YOUR OWN API KEY
You may optionally add your own OpenRouter API key on the Account page. Chat requests then run on your key instead of consuming credits. Your use of that key is governed by your agreement with OpenRouter, and you are responsible for charges it incurs. You can remove the key at any time.
6. YOUR CONTENT AND FEATURES
- You own the messages you write and the features you create.
- Publishing a feature to the marketplace grants us a license to host, display, and distribute it, and grants other users a license to install and run it. Your username is shown as the author.
- Submitted features are reviewed by a human before they appear publicly. Review is a curation and safety measure, not a guarantee — we do not warrant that any feature is free of defects.
- Installing any feature — including from the marketplace — runs its code in your browser. Install things you are comfortable running.
- We may reject, unpublish, or remove any feature at our discretion.
7. ACCEPTABLE USE
You agree not to:
- Violate any applicable laws, or use the service to generate unlawful content
- Create or submit malicious features — including code that exfiltrates data, deceives users, mines cryptocurrency, or interferes with the service or other features
- Harass, abuse, or harm others
- Attempt to gain unauthorized access, probe, or disrupt the service
- Circumvent rate limits, credit metering, or the email-verification requirement
- Resell or provide automated third-party access to the service
8. AI-GENERATED CONTENT
Chat replies and feature code are generated by third-party AI models. Output may be inaccurate, incomplete, or unsuitable for your purpose, and is not professional advice. You are responsible for how you use it.
9. INTELLECTUAL PROPERTY
- The foomchat service, brand, and our own code remain ours.
- Your content remains yours (see Section 6 for the publishing license).
- If you send us feedback or suggestions, we may use them without obligation.
10. TERMINATION
We may suspend or terminate access immediately for violations of these Terms, harm to other users, unlawful activity, or abuse of the service. You may stop using the service and request account deletion at any time (see the Privacy Policy).
11. DISCLAIMER OF WARRANTIES
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Scry Labs LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim shall not exceed the greater of fifty US dollars ($50) or the amounts you paid us in the twelve months before the claim.
13. DISPUTE RESOLUTION AND GOVERNING LAW
- These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions.
- Disputes will be resolved through binding arbitration conducted in Los Angeles County, California, except that either party may bring qualifying claims in small-claims court.
- You waive the right to participate in class actions.
14. CHANGES TO TERMS
- We may update these Terms; the date above reflects the latest revision
- We will make reasonable efforts to notify users of significant changes
- Continued use after changes constitutes acceptance
